Regarding how to apply and the requirements, I must say they are not simple; there are 10 basic requirements that must be met almost scrupulously for the UGE (Large Companies Unit) to accept these types of applications, so I recommend that you seek the support of a professional, whether an immigration lawyer, administrative manager, or social graduate expert in the field. It is important to know that this authorization can be applied for both from Spain and from the country of origin, and the documentation to be submitted is the same.

The 10 basic requirements are:

Documentation for International Teleworkers Applications:

• Copy of the entire passport or valid travel document (all pages).
• Proof of having paid the fee (form 790 038), attaching the payment receipt if it is not reflected on the form 790 itself.
• Application form signed by the teleworker (MIT Form).
• Proof of a minimum three-month professional or employment relationship with the foreign company/companies with which the relationship is maintained at the time of application.
• Proof of real and continuous activity for at least one year of the foreign company or group of companies with which the worker maintains an employment or professional relationship.
• Letter from the foreign company authorizing the development of remote work from Spain, accrediting the job profile, salary to be received, terms, and other conditions under which the remote professional activity will be performed.
• Copy of the qualification related to the job performance or, if applicable, substitutive minimum experience in similar functions to the position intended to be performed.
• Certificate of Social Security coverage (if there is an agreement with the country of origin) or registration with Spanish Social Security, proving at least the application for registration of the foreign company with Social Security and the commitment to register once the authorization is obtained before starting work.
• Current criminal record certificate from the country or countries where the applicant has resided for the last two years. Additionally, a responsible declaration of the absence of criminal records for the last 5 years (This will not apply when holding a residence or stay authorization in Spain for more than 6 months and has already been provided to obtain such authorization).
• Public or private health insurance. Travel insurance is not accepted (not necessary in the case of Social Security registration).
